The ILR Application Process

Applying for Indefinite Leave to Remain (ILR) involves a detailed and often complex process. Below, we provide an overview of the general requirements and steps involved:

Eligibility Criteria: Eligibility for ILR varies depending on your current immigration status. Generally, you should have lived legally in the UK for a specified period, typically five years. However, there are exceptions. For example, those on a Tier 1 Entrepreneur Visa may qualify in three years under certain circumstances.

Language Proficiency: Applicants need to prove their knowledge of English. This can usually be done by passing an approved English language test at level B1, B2, C1 or C2, or by having an academic qualification that was taught in English and is recognised by UK NARIC as being equivalent to a UK bachelor’s degree or higher.

Life in the UK Test: Applicants must also pass the Life in the UK test – a test that measures your knowledge about British life, history, and culture.

Absences from the UK: To qualify for ILR, you shouldn’t be outside the UK for more than 180 days in any 12-month period during the qualifying years.

Good Character Requirement: You should not have broken any UK immigration laws or have any criminal record.

Application Forms: ILR applications are made using form SET (O) or form SET (M), depending on your circumstances. The forms are lengthy and require detailed information, including your immigration history, employment status, and details of any public funds you have received.

Application Fee: There is a fee for the ILR application, which is currently £2,389 (as of 2023).

Biometric Information: You will also need to provide biometric information, including fingerprints and a photo.
